Last February, the First District Court of Appeals ruled that UC Berkeley’s Environmental Impact Review, or EIR, whose completion is required under the California Environmental Quality Act, was insufficient for two reasons. First, the plan did not “sufficiently consider” alternative locations, and second, it did not assess potential noise impacts from student parties.

However, according to the Court of Appeals, the case’s outcome does not require the university to abandon plans to develop People’s Park, but rather entails them modifying their EIR as per legal requirements. 

In response to the decision, Gov. Gavin Newsom signed AB 1307 last September, which effectively eliminates the need to consider student noise impacts when building housing.
