This is a victory for the rule of law and common sense. This investigation should never have been opened and smacked of vindictiveness.⠀

A key issue here is whether companies who negotiate a settlement with state or local governments can be subject to antitrust liability.  Under the Noerr Penington doctrine, which follows from the right to petition the government, the answer is no.⠀

As for the right of California, Colorado, and other states to set higher mileage standards than the feds, we will continue to defend our right to protect our air quality.⠀
