He criticized DHS for being “on the verge of running out of money for the fiscal year” and for “illegally refusing to spend funds that have been authorized by this Congress and appropriated by this committee.” Murphy accused DHS of implementing a new immigration system that deviates from existing statutes, stating, “You are ignoring the immigration laws of this nation, implementing a brand new immigration system that you have invented.” He emphasized that immigrants, regardless of citizenship status, have constitutional and statutory rights, and that DHS’s actions suggest a disregard for these legal obligations.

Murphy also highlighted the potential violation of the Anti-Deficiency Act, noting that DHS is “on track to trigger the Anti-Deficiency Act,” which prohibits federal agencies from spending more than what Congress has appropriated. He expressed concern that DHS’s focus on border enforcement has led to the reallocation of funds from other critical areas, such as cybersecurity and disaster prevention, thereby leaving the country vulnerable to other threats. Murphy concluded by reminding DHS officials that they are required by law to process asylum claims, stating, “The law requires you to process people who are showing up with the border and who claim asylum.”
