The Berkeley City Council paused the implementation of a March resolution banning the sale or use of algorithmic devices to set rent prices amid ongoing litigation during its regular meeting June 24. 

Although the policy went into effect April 24, the city adopted the first reading of an ordinance delaying the start of the ban to March 1, 2026.The development followed a lawsuit filed by RealPage, a company that develops and distributes artificial intelligence pricing algorithms to managers of rental properties, in early April.
 
In its April lawsuit, RealPage claimed that banning the software infringed upon First Amendment protections of content-based speech. It also alleged that by not providing fair notice of “what conduct it prohibits,” the city also violated the Due Process Clause of the 14th Amendment.
