Ten years after the Supreme Court’s Obergefell v. Hodges decision legalized same-sex marriage nationwide, Davis is asking the justices to overturn it per abcnews. ___________________________________
Davis is appealing a $100K jury verdict for emotional damages, plus $260K in attorney fees. In her petition to the Supreme Court, she argues the First Amendment’s religious protections shield her from personal liability and calls Obergefell “egregiously wrong.”___________________________________
Her filing states marriage laws should be decided by each state not the federal government. This is similar to how abortion rights were returned to the states when Roe v. Wade was overturned in 2022. She also points to Justice Clarence Thomas’ prior call to revisit the marriage ruling. ___________________________________
