Attorneys for #PaytonGendron, the white supremacist who killed 10 Black people in a Buffalo supermarket, asked a judge last week to dismiss his federal charges, claiming the grand jury lacked Black and minority representation.

As reported by USA Today, Gendron’s lawyers said Black and Hispanic people are “systematically” underrepresented in the Southern District of New York’s jury pools, violating defendants’ rights. In response, the U.S. Attorney’s Office said Gendron’s team failed to prove any systematic underrepresentation and urged the judge to reject the motion. U.S. District Judge Lawrence Vilardo noted the objection seemed “a little incongruous” in a hate crimes case, but has not filed a decision.

If convicted, Gendron could face the death penalty for the 2022 mass shooting at Tops, which he targeted because of its predominantly Black neighborhood. Victims ranged from 32 to 86 years old; three others were injured. He is already serving life without parole after pleading guilty to state charges in 2022.

A federal trial on hate crime and weapons charges is expected next year.
