Don’t Be Fooled: That “Bulletproof Trust” Might Blow Up Your Finances.

Let’s clear the air on something that’s showing up all over social media right now — and could get you in serious trouble if you’re not careful.

Promoters are pushing these so-called “irrevocable discretionary complex spendthrift trusts” as a magic solution for:

	1	Asset protection.
	2	Tax deferral.
	3	Wealth transfer.

Sounds great, right? Too great.

Here’s the truth:

Most of these structures are anything but bulletproof.

In fact — they are riddled with problems.

Let’s break it down:

🚫 Asset Protection:

The Uniform Voidable Transactions Act (UVTA), now adopted by many states (including California), gives courts wide latitude to unwind sham transactions — especially when you transfer assets into a trust that had no value before your contribution.

If you think a clever legal wrapper will fool a court — you’re betting wrong.

🚫 Tax Deferral:

Many of these promoters misinterpret IRC Section 643 — quoting it wildly out of context.

Here’s the issue:

They conflate the treatment of distributable net income with the actual taxation of income itself.

That’s a fundamental misunderstanding. And one the IRS has addressed directly.

🚫 Legitimacy of Transfer:

You can’t simply “sell” your own assets to a trust you funded, get a note in return from an entity that had no prior value, and call it legitimate.

Courts see through this. The IRS sees through this. You should too.

Bottom line:

If you’re seeing these schemes pitched online as:

✅ Tax-free.
✅ Anonymous.
✅ Lawsuit-proof.
✅ “Invisible wealth”.

Run. Do not walk — run.

👉 And don’t take my word for it.

Go to irs.gov and search for memos on abusive trust arrangements. You’ll see exactly how this plays out.

Remember:

You want strategies that work in the real world — not ones that fall apart the first time they face scrutiny.

Want to learn the real rules of the game of business?

The ones that actually stand up — legally, strategically, and tax-efficiently?
