Offshore Trusts? Think Twice Before You Go Global 🌍

I recently spoke with a top-tier CPA who works exclusively with high-net-worth individuals about offshore planning — specifically trusts in jurisdictions like the Cook Islands and Swiss bank accounts.

We both came to the same conclusion:

For most people, offshore trusts aren’t the move.

Here’s why:

1️⃣ Permanence.

Once you offshore an asset, it’s essentially gone.

If you bring it back into the U.S., it becomes subject to U.S. jurisdiction again.

So if you’re not 100% sure you want that asset to stay offshore—don’t send it.

2️⃣ Loss of Control.

Many of these structures are irrevocable.

You don’t get to change your mind later.

And someone else—often in a foreign country—is controlling your money.

3️⃣ Complexity.

These aren’t DIY strategies.

They require:

Precise legal structuring.

Cross-border tax compliance.

Deep understanding of multiple jurisdictions.

One mistake can blow the whole thing up.

So, is offshore planning ever appropriate?

Yes — for the right person, with the right assets, and the right risk exposure.

But for most business owners?

There are safer, smarter domestic structures that can deliver protection without the complications of going global.

If you’re serious about protecting what you’ve built, start by learning the actual rules of the game.
