The UK’s approach to new guidance on trans rights may be in breach of the European Convention on Human Rights (ECHR), Europe’s human rights watchdog has warned.

Michael O’Flaherty, the Human Rights Commissioner for the Council of Europe, has written to Sarah Owen, chair of the parliamentary women and equalities committee, and Lord Alton, chair of the joint committee on human rights, expressing serious concerns.

O’Flaherty specifically warned against implementing measures that exclude trans people from everyday life: “It should be ensured that steps taken towards implementing the Supreme Court judgment avoid a situation where a person’s legal gender recognition is voided of practical meaning, to the extent that it leaves trans people in an unacceptable ‘intermediate zone’.”

He also stressed that protection from discrimination must extend to all trans people, regardless of their status.
