GUILTY — NOT BY ACCIDENT, BUT BY CHOICE.
In this jurisdiction, human beings were reported dead.
Calls for service were made.
Exact locations were provided.
And the agencies legally responsible for responding chose not to act.
The New Mexico Office of the Medical Investigator Chief Heather Jarrell at the Doña Ana County Sheriff Kim "K.K." Stewart have refused — repeatedly.
As a result, human beings are left decomposing in the desert.
Not lost.
Not unknown.
Not hypothetical.
Some have identification.
Some have cell phones.
Some have clothing, prayer cards, personal items — the unmistakable evidence of a life.
And still, they are left there.
Let’s be clear about what this is not.
This is not a staffing issue.
This is not a communication breakdown.
This is not a misunderstanding of responsibility.
This is abandonment.
And it is not random.
If the deceased had been white, middle-class, and found near a trailhead, a ranch road, or a suburban edge, there would have been an immediate response. Sirens. Scene tape. Statements. Recovery. Paperwork. Respect.
They would not be left to bleach into the sand.
But these dead are presumed to be brown.
Presumed to be Indigenous.
Presumed to be undocumented.
And so they are treated as disposable.
This is the unspoken policy:
Delay until decomposition erases evidence.
Ignore until responsibility becomes deniable.
Let the desert do the work.
That is not negligence — it is state-sanctioned indifference.
Families are robbed of the chance to bury their loved ones.
Robbed of truth.
Robbed of closure.
The dead are robbed of dignity.
Robbed of justice.
Robbed of even being acknowledged as worthy of recovery.
When agencies tasked with death investigation ignore calls for service, they are making a value judgment — about who counts and who doesn’t.
Human remains were reported.
The law is clear.
The response was refusal.
This is how racism operates when it wears a uniform and speaks in procedural language.
