With the High Seas Treaty now in effect, what does that mean for deep-sea mining? It’s complicated…

Mining companies are eyeing the deep sea for minerals like nickel and cobalt, but scientists warn we don’t know enough about these ecosystems to avoid serious harm. For decades, the International Seabed Authority has overseen the seabed itself, but not the vast water column above it. And there’s no realistic way to mine the seafloor without disturbing the ocean above, which is what the High Seas Treaty now governs.

The treaty introduces environmental impact assessments and the ability to create protected areas on the high seas, raising the bar for industrial activity, including mining.

It can’t override existing bodies, which means we now have conflicting systems. How that plays out remains to be seen. But for the first time, biodiversity has legal weight in international waters. That gives us a rare opportunity to set a precedent by choosing science, precaution, and protection from the start.
