Min Heejin (min.hee.jin) has won the first trial in her lawsuit against HYBE over stock sale payments.

The Seoul Central District Court ordered HYBE to pay Min 25.5 billion KRW (about $17.5 million USD). It also ruled that former ADOR executives who exercised put options should receive 1.7 billion KRW (about $1.16 million) and 1.4 billion KRW (about $960,000), respectively.

At the same time, HYBE’s separate lawsuit seeking confirmation of the termination of the shareholders’ agreement was dismissed. The court said that while Min may have explored ways to make ADOR more independent, that alone did not constitute a material breach of the shareholders’ contract.

HYBE has since stated it will review the ruling and proceed with further legal steps, including a possible appeal.

민희진 전 어도어 대표가 하이브를 상대로 제기한 주식 매매대금 청구 소송 1심에서 승소했습니다.

서울중앙지법 민사합의31부는 하이브가 민 전 대표에게 255억 원을 지급하고, 함께 풋옵션 행사를 통보했던 어도어 전 부대표와 전 이사에게 각각 17억 원, 14억 원을 지급하라고 판결했습니다.

또한 하이브가 민 전 대표를 상대로 제기한 주주 간 계약 해지 확인 소송도 기각됐습니다. 재판부는 민 전 대표가 어도어의 독립 방안을 모색한 사실은 인정되지만, 그 사정만으로 주주 간 계약을 중대하게 위반했다고 보기는 어렵다고 판단했습니다.

이에 하이브는 판결문을 검토한 뒤 항소 등 후속 법적 절차를 진행하겠다는 입장을 밝혔습니다.
