A federal appeals court on Wednesday put temporary holds on orders by two Oregon judges that restrict federal use of force outside the U.S. Immigration and Customs Enforcement building in Portland.

A split three-judge panel of the 9th U.S. Circuit Court of Appeals issued an emergency hold on the March 6 order by U.S. District Judge Amy Baggio, who restricted federal officers from deploying tear gas or other chemicals that could seep into the apartment complex near the ICE building in Portland. That case was filed by Gray’s Landing and its property manager, REACH Community Development.

The temporary holds are intended to maintain the status quo, the panel said.

“An administrative stay is intended to ‘minimize harm while an appellate court deliberates’ and lasts ‘no longer than necessary to make an intelligent decision on the motion for stay pending appeal,’ ” according to its ruling.
