You read correctly. In our US v. Idaho case the government's attorney called Idaho's attempt to protect & steward their stock water resources UNCONSTITUTIONAL! The government however seems to ignore all of their own constitutional violations that MSLF is fighting against every day. 
Apparently enacting laws that protect your state's resources offends the government so much they consider it illegal.
