Government overreach is NEVER okay. The recent actions by the D.C. Circuit Court signal a disturbing trend of judicial overreach through the weaponization of the National Environmental Policy Act (NEPA). The case Seven County Infrastructure Coalition v. Eagle County, Colorado, currently pending before the Supreme Court, will determine if those in the natural resources industries will have to grapple with yet another regulatory burden.
Mountain States Legal Foundation and American Forest Resource Council have teamed up to take on the challenge of reining in the weaponization of NEPA. Our amicus brief takes on the misuse of NEPA and the fact that unelected judges shouldn’t be ignoring Congress and making their own policies from the bench.
The D.C. Circuit Court has decided to try and derail the approval of a much-needed rail line through the Uinta Basin in Utah, even though Congress had already stated that building rail lines like are in the public interest. This underscores the need for judicial restraint as the court is overstepping its authority in this matter.
