Olivia Andre and her family filed for asylum as a unit after coming to the U.S. from the Democratic Republic of Congo in December 2022, when Andre was a minor. 

They made their way to Maine, where Andre graduated high school a year and a half early, the family’s attorney said. 

She was in her first year of college to become a nurse when ICE arrested the family, detaining Andre separately as an adult and sending her to Dilley Immigration Processing Center in South Texas, where she remains today.

Andre, now 19, is still considered part of their asylum application that is under review by a federal circuit court. A federal appeals court has blocked the family’s deportation — a ruling that includes Andre — for now as it reviews their asylum case, a process that could take months or longer, the attorney said.

A DHS spokesperson said the family had received “full due process” and that the family “have been released from ICE custody pending their removal from the U.S.”
“DHS is working rapidly and overtime to remove these aliens from detention centers to their final destination — home,” the spokesperson said. “The facts are Olivia Mabiala Andre is an adult illegal alien with a final order of removal and no right to remain in the U.S.”
