Case update — the Andrew Donald Little matter, 18 months in.

In December 2024, a registered Melbourne builder was immediately suspended by the regulator under section 180A(2A) of the Building Act 1993 — a power that applies before any merits hearing, in the public interest, pending the show cause process.

Where the case sits now:

• Immediate suspension: in force until 30 November 2027 unless stayed or revoked
• Disciplinary decision (3 March 2025): 53 of 58 grounds substantiated, 3-year disqualification, registration cancelled, $160,000 in fines
• VCAT [2025] 277 — stay refused
• VCAT [2026] 345 — applications under ss 75 and 78 of the VCAT Act dismissed (14 May 2026)
• Substantive review of the suspension and the 3 March disciplinary action: still pending
• Next admin mention: 30 May 2026
The show cause notice listed 86 alleged factual breaches across 58 grounds, including non-compliant fire safety design and taking money for domestic building work without compulsory insurance. None of these allegations have been tested on the merits at VCAT.
