The Cullman City Council voted unanimously on June 22 to approve a year-long moratorium on data centers, without commentary. That marks the fourth known city to do so, following Birmingham in March, Leeds in early June, and Homewood the same night.

“The City Council finds that the rapid emergence and potential proliferation of such facilities require careful study of their compatibility with the City’s existing zoning districts, infrastructure capacity, environmental resources, residential quality of life, and long-term economic development goals,” the resolution reads.

The pause is “intended to be temporary” for one year, per the resolution, while staff and the Planning Commission review its zoning policy with public engagement. But the City Council could extend the moratorium for longer, or end it earlier.

“Any violation of this moratorium shall be subject to the penalties and remedies available under the City’s Zoning Ordinance and other applicable laws, including injunctions and abatement as a public nuisance,” the resolution reads. “Each day a violation continues shall constitute a separate offense.”

Birmingham’s moratorium lasted just three months, ending mid-June after the city adopted new regulations for data centers in its zoning policy. Other cities like Columbiana and Athens have added specific review measures for data centers to their zoning policy, without pausing potential development.
