More than five hours later, staff found him breathing in the morgue. The toddler was pulled unresponsive from a backyard pool during a Super Bowl party on February 8. First responders rushed him to Mercy Gilbert Medical Center, where a doctor pronounced him dead at 6:20 p.m. According to the newly released police report, officers flagged possible signs of life more than once. One heard a nurse say she had a pulse before time of death was called, and a detective reported hearing gasps as the boy was moved to the hospital’s cold room. The report says the doctor told an officer “I went to medical school for a reason,” and staff attributed the sounds to agonal breathing. At 11:52 p.m., the boy was found breathing in the morgue and airlifted to Phoenix Children’s Hospital. He survived, has been released, and is expected to need physical therapy. His family plans legal action against the doctor and Dignity Health, according to their attorney. Gilbert police have recommended felony child abuse charges against his parents, who the report says admitted using marijuana during the party.
