Meta Platforms, TikTok, Google, and Snap have just lost one of the most consequential court battles they have faced in years over how their platforms affect young users. On Monday, August 10, 2026, the 9th U.S. Circuit Court of Appeals in San Francisco dismissed Meta and TikTok's attempt to overturn a lower court ruling and let more than 3,000 lawsuits, currently consolidated in a federal multidistrict litigation in California, move forward. The suits, brought by school districts, state attorneys general, families, and individual young users, accuse the social media giants of intentionally designing addictive products that contributed to youth mental health harms including anxiety, depression, sleep disorders, and self-harm. The tech companies had argued that Section 230 of the Communications Decency Act of 1996 the law that generally shields online platforms from liability for content posted by their users should also protect them from failure-to-warn claims about the addictive design of their apps. The 9th Circuit disagreed, ruling that Section 230 provides "a defense to liability, not immunity from suit," meaning the appeal was premature and the court had no jurisdiction to review it. Plaintiffs' attorneys Lexi Hazam and Previn Warren said the decision clears the way for the states' trial to proceed as well as a separate school-districts trial scheduled for February 2027. The ruling comes just days after another major legal setback for Meta. On August 6, 2026, First Judicial District Court Judge Bryan Biedscheid in New Mexico ordered the company to pay $567 million into an abatement fund and implement significant platform changes for minors, calling Facebook and Instagram a "public nuisance" akin to air pollution. The New Mexico award included $420 million for treatment services, $90 million for screening, $33 million for prevention and awareness, $15 million for referrals and care coordination, and $9 million for oversight, and is on top of $375 million in civil penalties already imposed by a jury in March a combined $942 million against Meta in that state alone. Meta has said it disagrees with the ruling and plans to appeal. In premarket trading Tuesday, Meta shares traded at $599.12, Alphabet at $343.80 (down 3.84%), and Snap at $5.51.
