Jason Munroe of Whitby will keep his original sentence after Ontario’s Court of Appeal rejected the Crown’s attempt to have it increased.

The case stems from a violent 2022 home invasion in which Munroe’s son was shot. Munroe managed to wrestle the handgun away from the intruders and was found to have acted in self-defence while inside the home.

However, the court found him guilty of reckless discharge of a firearm for shooting at the suspects as they fled, as well as obstruction for initially lying to police.

Munroe was sentenced to 729 days of house arrest and three years of probation.

Appeal judges described the circumstances as “exceptional,” pointing to the fact that Munroe had just witnessed his son being shot, along with his remorse, rehabilitation, stable employment and dedication to his family.

The Crown wanted a tougher sentence, but the Court of Appeal ultimately found no reason to increase it.
