A grand jury has indicted a former Tempe Union High School District surveillance officer on eight counts of voyeurism, one more than he was originally arrested on.

Antony Cruz, 28, was arrested by Tempe police on August 22 on seven counts. The indictment was filed within a week. According to court documents, Cruz accessed a security camera in a room at Corona del Sol High School that students were using to change clothes while the girls’ locker room was closed for renovations, and downloaded footage to personal storage devices.

The case surfaced because of an audit. A district security supervisor reviewing Cruz’s security system activity flagged it and alerted police. Court records indicate the system’s download history showed videos exported to external devices, and that cloud storage was accessed from an IP address believed to be his home.

Cruz denied the allegations in court. He told the judge he did not have any sexual stimulation or sexual anything with the videos, that he saved them for documentation purposes, that he felt uncomfortable with the cameras, and that he tried to move them and notify his superiors. The police report states otherwise. He has not been convicted.

There is a second question here, and the district is now investigating it. Court documents say school officials requested the cameras in that room be disabled, but they were inadvertently left functioning. District officials say the space is a dance room, that it was never designated by the district as a place for students to change, and that during the renovations they had approved a separate camera-free location that was not the one used.

In a letter sent to families on August 31, the district said the Tempe Police Department believes there are additional victims in the case.

Parents spoke at Wednesday night’s school board meeting. Cruz was scheduled to be arraigned Thursday morning and remains held on a $100,000 cash-only bond.
