Attorneys representing three friends who were with #NolanWells before his death are pushing back on claims that their clients deleted messages from Wells’ phone, and they say they plan to sue family attorney Ben Crump for defamation.

A report from newsnation states that Edward Andrew Paltzik, who represents Warren Hudson, Jax Pitalo, and Morgan Seymour, denied that his clients were responsible for deleting any data from Wells’ phone. “Warren, Jax, and Morgan did not erase anything and never had access to his phone,” Paltzik told TMZ_Tv. “If anything was erased, they didn’t do it.”

The attorneys’ statements come after forensic examiner Andrew Garrett, who Wells’ family hired, said during a Thursday news conference that messages were deleted from Wells’ phone sometime between its last use on July 4 and when it was returned to his family.

Garrett said he could not determine who deleted the data, but said, “somebody had to take a user action to delete data.” Attorney Tyler Cox, who also represents the three men, said a woman in the group collected phones that had been left on the boat, including Wells’ phone, and placed them in a truck.

Crump has said Wells’ phone data, including Snapchat messages, was turned over to the district attorney. However, Paltzik disputed that Crump had provided the physical device itself. According to Garrett, more than 280 pages of records showed Wells used Snapchat and Instagram for about 95% of his communications. Garrett also said a group chat involving Wells’ friends continued after his death, with participants apparently unaware that the messages were syncing to his phone.
