Amazon will refund residents of two D.C. ZIP codes in Ward 7 and Ward 8 $7.25 million after the District’s attorney general says the company secretly excluded Amazon Prime customers from the expedited delivery service they paid for.⁠

The Office of D.C. Attorney General Brian Schwalb and Amazon reached a settlement, the office announced Thursday. D.C. sued the retail giant in 2024.⁠

Schwalb’s office said Amazon “violated DC consumer protection law by secretly excluding two DC ZIP codes east of the Anacostia River from Amazon’s in-house, Amazon-branded delivery services — significantly slowing Prime deliveries to those areas — while continuing to charge tens of thousands of DC residents living there the full Prime subscription price.”⁠

Amazon admitted no fault in the settlement and said it made delivery decisions in D.C. based on safety concerns at the time.⁠

“The safety of our customers and the drivers delivering to them has always guided our operational decisions — full stop,” a spokesman said. “In the zip codes at issue, drivers faced specific, documented safety threats, and we adjusted operations to protect them, while still supporting delivery through other carriers.”⁠

The spokesman said, “claims that our practices, at any point, were deceptive are false — we’re transparent with customers about delivery timelines throughout.”⁠

In addition to the refunds to customers, as part of the settlement, Amazon will pay D.C. $1 million in penalties. Also, in the future, the company must notify existing customers and prospective customers who enter an affected address during the signup process of any expedited delivery exclusions.⁠

Schwalb’s office said that while companies are legally allowed to make changes to their operations, they must inform customers of “any adverse impacts those changes will have on the quality of service so that consumers can make informed purchasing decisions.”⁠
