Cypress Fairbanks Independent School District is named in the 2025 lawsuit by 18 families that argue that SB10 is a direct violation of the Establishment Clause, hindering religions/non religions other than Christianity. Two federal judges in Texas have ruled the bill unconstitutional, however the legal battle remains through lawsuit “Rabbi Nathan v. Alamo Heights Independent School District” (Case No. 5:25-cv-00756). Filed by the ACLU of Texas and the Freedom From Religion Foundation, this lawsuit is on the behalf of 18 different multi-religious Texas families. These families claim commandments such as “I am the lord thy god”, “Thou shalt have no other gods before me” and “Thou shalt not take the Name of the Lord thy God in vain” are a direct infringement of the religious freedom principles established by the founders of this nation.
Similar cases have been shot down by the courts in name of religious indoctrination, as seen in Stove v. Graham, U.S. 39, 42 (1980), where the Supreme Court vetoed a Kentucky law mandating classrooms to display the 10 commandments, deciding such displays would unconstitutionally “induce school children to read, meditate upon, perhaps to venerate and obey, the Commandments.” These cases claim requiring the 10 commandments to be displayed will pressure as well as divide students by those which follow the scripture and those that do not.
After asking numerous CFISD students their opinions on the matter, responses vary vastly. “As a Chistian, I personally use the 10 commandments as my moral compass and I know many fellow believers who use it as well. From a strictly religious standpoint, I believe having the 10 commandments in classrooms would be very beneficial” Cypress Fairbanks ISD student said. While a popular belief within CFISD, other students believe “CFISD [hanging] the Ten Commandments would take a step further to pushing religion onto [students]. [The bill] could harm how safe other religions feel in classes or clubs that focus on providing a safe space for religions outside Christianity, it’s better to stop [the bill] now before it gets worse,” Cypress Fairbanks ISD student said.
