The U.S. Department of Education announced Monday that it is formally rescinding a 2024 rewrite of Title IX regulations, reinstating President Donald Trump’s 2020 Title IX framework that interprets the law based on biological sex.

Following the passage of the Education Amendments of 1972, Title IX was created to prohibit sex-based discrimination in schools that receive federal funding. In 2024, then-President Joe Biden expanded these protections to include frameworks barring discrimination based on sexual orientation and gender identity, added safeguards for pregnant students and broadened definitions of sexual harassment.

Now that the Department of Education has rolled back this expansion, Title IX will be interpreted following the 2020 framework, established during the first Trump administration, meaning sex-based protections will solely apply on the basis of biological sex — a distinction the department press release calls “biological reality, not ideological fantasy.”
