The Iowa bill that would have shielded pesticide and herbicide manufacturers from "failure to warn" lawsuits didn't survive the 2025 legislative session.
Now, those manufacturers are turning to the courts for relief.
German agribusiness giant Bayer in April announced it filed a petition for writ of certiorari, essentially a review, with the U.S. Supreme Court, claiming that "failure-to-warn lawsuits" brought against the company warrant review and resolution by the country’s top court.
The Iowa bill that didn't have enough support in the House, Senate File 394, would have protected pesticide and herbicide manufacturers from claims that their products' labels failed to disclose potential health risks, such as cancer, as long as their labeling adheres to U.S. Environmental Protection Agency rules.
