The Trump administration on 19 September filed an emergency appeal asking the Supreme Court to halt a lower court order that allowed transgender and non-binary people to change the s3x marker on their passports despite an earlier administration policy denying such changes. An executive order was issued in January 2025 defining s3x strictly as “male or female” based on “immutable biological classification.” In June, Judge Julia E. Kobick issued a preliminary injunction blocking enforcement of the policy for plaintiffs who sued over its discriminatory impacts.
