Survivors of human trafficking are often seen as criminals in the eyes of the legal system instead of the former victims of a horrific crime. In 2022, only 28 states and D.C. had enacted laws preventing the prosecution of child trafficking victims for commercial sex. Among them, only 10 states went further to shield these young survivors from arrest, detention, and charges related to commercial sex. Survivors are often left with criminal records due to being forced to engage in illegal activity. When survivors carry a criminal record, their ability to obtain employment, housing, education, benefits, and financial assistance is much more difficult.
