In a unanimous decision released June 6, the California Supreme Court overturned the Court of Appeals’ ruling on People’s Park in an opinion that primarily boiled down to the application of Assembly Bill 1307. AB 1307, which passed following the Court of Appeals decision halting construction on People’s Park, added two sections to the California Environmental Air Quality Act removing considerations of noise and alternative sites for housing projects in environmental impact reviews if certain criteria are met. The aforementioned two amendments addressed the crux of the Court of Appeals’ reasoning for requesting that UC amend its Environmental Impact Review, as per CEQA guidelines.
