According to the Berkeley Police Department’s hate crime policy, a hate incident includes the distribution of hate material in public spaces or on private property. Hate incidents include name-calling, the use of epithets and the promotion of hate material in public places or one’s own home. It differs from a hate crime, as no criminal act is committed.
Councilmember and Vice Mayor Susan Wengraf of District 6 said Berkeley has a zero tolerance hate policy, adding that she and her Northside district residents are “disgusted” by the incident.
BPD believes the distributors drove through the district and threw bags with the flyers at random.
