Councilmember Brent Blackaby’s proposal included an article in the original recommendation to affirm the Police Accountability Board’s access to relevant documents and information. However, he urged PAB and BPD to confer about state law limitations, a point of contention in the past. PAB Chair Joshua Cayetano said there have been times the PAB was forced to subpoena Berkeley police as they refused to hand over requested data. He said, in general, BPD often takes two weeks to six months to comply with document or data requests.
