The proposed cap was announced Feb. 7 in supplemental guidance issued by the Office of the NIH Director, and if enforced, could have cost UC Berkeley $37 million in funding. NIH is the UC system’s single largest research funder, contributing $2.6 billion in research funding to the university in 2024.
According to the Feb. 7 NIH supplemental guidance, research institutions have negotiated indirect cost rates in the past, typically receiving around 27% to 28% in reimbursement. The docket for the case said the plaintiffs sought relief by requiring the government to respect the negotiated rates.
