Unhoused residents of the 8th and Harrison encampment who filed for Americans with Disabilities Act, or ADA, accommodations were granted a limited injunction temporarily protecting them from displacement at a hearing Tuesday.
However, the city of Berkeley will be allowed to evict encampment residents who haven’t already filed ADA claims, after providing one week’s notice to residents.
U.S. District Judge Edward M. Chen, who decided the ruling, also ordered the city to discuss ADA accommodations with residents over the next 60 days. Another hearing will take place when this process concludes.
