Barbara J. Kornegay, 80, was fatally injured when the vehicle crashed head-on with a pickup driven by 71-year-old James M. Hollingsworth of Kennedy.
According to court documents, Hollingsworth was indicted June 4. At the time of the wreck he was driving under the influence of alcohol.
Criminally negligent homicide is a Class-A misdemeanor unless the driver was under the influence. When that's the case, the charge is upgraded to a Class-C felony with a minimum of one year and one day in prison and a maximum of 10 years in prison.
