The High Court has scheduled a hearing for November 2025 to consider a judicial review challenge brought by Good Law Project against the Equality and Human Rights Commission’s interim guidance. The guidance, published in April 2025 following the UK Supreme Court’s ruling in “For Women Scotland v Scottish Ministers,” advises that gendered facilities should be allocated based on “biological s3x” and discourages use of toilets aligned with a trans person’s gender identity. The claimants argue that the EHRC’s update misstates the law and instructs employers and public bodies to act outside the Equality Act 2010, the Human Rights Act 1998, and the Gender Recognition Act 2004.
