When someone decides to end their own pregnancy, they should be able to. They should have access to abortion care as soon as they need it. It should be safe and affordable. And no one should be punished for having an abortion. Viability is understood to mean when a fetus might be able to survive on its own, “if birth occurs.” As a legal standard, fetal viability is a vague concept without a clear medical definition. And yet, in Roe, the judges decided it was a reasonable point to override a pregnant person’s rights.
