The Supreme Court just ruled in a 6-3 vote that lower courts may not issue nationwide injunctions blocking the Trump administration’s executive order aiming to end birthright citizenship. While the Court did not address whether the executive order is constitutional, it established that judges can only shield the plaintiffs directly involved in a case, limiting judges’ abilities to challenge the administration going forward. Justice Sonia Sotomayor, who wrote the dissenting opinion, warned of the harmful precedent that the decision sets:
“To allow the Government to enforce [the birthright citizenship executive order] against even one newborn child is an assault on our constitutional order and antithetical to equity and public interest,” she wrote. “No right is safe in the new legal regime the Court creates.”
