Donald Trump filed an executive order intending to terminate birthright citizenship and end the automatic granting of citizenship to children born in the United States just hours after he was inaugurated on Jan.20. According to the order, children born in the U.S. to parents who are “unlawfully present,” “not a United States citizen or lawful permanent resident” or in the country under legal but temporary status will no longer be recognized as citizens by the Social Security Administration and State Department. If approved, the order would go into effect in 30 days but would not be retroactive. However, experts say the order will face many legal challenges, as the 14th Amendment in the U.S. Constitution states that “all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside” and has long been interpreted to mean that anyone born in the U.S. automatically becomes a citizen.
