The Supreme Court just gave ICE the go-ahead to profile Latinx people based on their race or ethnicity, language, or job in a devastating 6-3 decision on Monday, September 8. The Supreme Court’s three liberal justices strongly dissented to the decision, which lifted a federal judge’s order barring agents from making stops without “reasonable suspicion.
“We should not have to live in a country where the Government can seize anyone who looks Latino, speaks Spanish, and appears to work a low wage job,” Justice Sonia Sotomayor wrote in her dissent.
The decision reverses an order by US District Judge Maame E Frimpong, who said that the Trump admin can’t rely on factors including race or ethnicity, speaking Spanish, or place of work alone to stop individuals and that ICE’s indiscriminate “roving patrols” may violate the Fourth Amendment of the Constitution prohibiting unreasonable government searches and seizures.
