I’ve always thought of the First Amendment as a bargain. In 1977, my hometown of Skokie, Illinois, was forced to grant a permit to a socialist group of self-styled Neo-Nazis who wanted to host a “white power” demonstration. Skokie initially refused to grant the permit, but the demonstrators sued and ultimately won on appeal all the way up to the US Supreme Court. Because that is the deal. I will accept the right of Neo-Nazis to march down the streets of my hometown in exchange for my right to march against them. The First Amendment is blind to content because it must be.
