The ruling, issued by Judge Julia Kobick in the case Orr v. Trump, forces the US State Department to resume issuing passports that reflect a person’s gender identity, including the “X” option for non-binary applicants.
The ACLU filed the lawsuit, arguing that the policy violated the Equal Protection Clause and discriminated against citizens based on their seggs and gender identity. Li Nowlin-Sohl, senior attorney at the ACLU’s LGBTQ & HIV Project, stated: “This decision is a critical victory against discrimination and for equal justice under the law. But it’s also a historic win in the fight against this administration’s efforts to drive transgender people out of public life.”
