In a win for the Polish LGBTQ+ community, a top European Union court has ruled that Poland must recognise same-sex marriages that have been legally performed in other EU countries. The case started when two Polish nationals married in Germany in 2018 and asked authorities to transcribe their union into Poland’s civil register. The officials denied the request, arguing that Poland offered no legal status for same-sex couples. The couple challenged the refusal, and the case was referred to the EU Court of Justice. The verdict, delivered on 25 November, found that same-sex couples “must have the certainty to be able to pursue that family life upon returning to their member state of origin,” and that offering transcription to straight couples but not same-sex ones amounts to discrimination, it added.
