Charles Lee “Sonny” Burton did not pull the trigger that killed Doug Battle in 1991.
He didn’t tell anyone to fire the shot, nor was he in the building when it happened, according to Burton’s petition for clemency as the date of his execution nears.
But under Alabama law, if a death occurs during the commission of a dangerous crime, anyone involved can face life in prison or the death penalty.
Burton is scheduled to be executed by nitrogen hypoxia on March 12, during Ramadan. Calls for clemency are growing as the story gains national attention.
