Government overreach is NEVER okay. The recent actions by the D.C. Circuit Court signal a disturbing trend of judicial overreach through the weaponization of the National Environmental Policy Act (NEPA). The case Seven County Infrastructure Coalition v. Eagle County, Colorado, currently pending before the Supreme Court, will determine if those in the natural resources industries will have to grapple with yet another regulatory burden.
