But it was KBJ's concurring opinion that stopped legal experts in their tracks. Jackson, joined by Justice Sotomayor, declared the court's landmark 2022 Bruen test "unworkable," arguing it forces judges to apply centuries-old historical evidence to modern gun questions, leading to "inconsistent and arbitrary" outcomes.
