An Arizona man is accused of driving drunk with a child in the backseat after police say they found an open beer spilled right next to them.
Police say 35-year-old David Zuniga was pulled over late at night in Maricopa after officers noticed his registration was expired. According to the probable cause statement, he passed several places where he could’ve safely stopped before finally pulling into a strip mall.
When he got out, officers say he smelled like alcohol and struggled to walk in a straight line.
Inside the SUV, police allegedly found an open beer spilled across the backseat next to the child.
Zuniga reportedly told officers he had two beers at dinner. Police say a preliminary breath test came back at .134, above Arizona’s .08 legal limit.
Officers also learned his license was suspended.
He was arrested on suspicion of aggravated DUI, child endangerment and driving on a suspended license.
