A Harris County Defendant was recently acquitted of the felony offense of continuous sexual abuse of a child, despite there being a cell phone video recording of the Defendant forcing the 9-year-old child to perform oral sex on him. Prosecutors were not able to use the cell phone video during trial because it was ruled that the Defendant’s then-girlfriend, who discovered the video on the Defendant’s cell phone, did not have consent to access his cell phone at the time in which she found the video. This is absolutely not okay!
